Almost seven years ago to the day, I wrote what became one of this site's perennially most popular posts ("Another Day, Another Scam -- this one targeting small business"), which was a post about a scam operation that sends small (and large, probably) businesses and nonprofits a very hyper-official looking notice about the required annual renewal for their corporate or company registration. The annual registration renewal is something anyone can do for their own business on a cell phone in under 10 minutes (first time, less after that) at no charge. This shady outfit sending the notices wanted something like $100 bucks to do it for you, and they have a very shady way of wording the notice to make it seem like you really ought to send them the money. They don't come out and lie in a way you could prosecute -- but they rely on the fact that a lot of people struggle with bureaucratic forms, and are under such pressure and tension when they think about doing anything involving government that they lose their natural skepticism and thus can be scammed. I thought that maybe the popularity of my warning had helped put them out of business, but in today's mail, I see that they're back. The latest version of the form is similar -- it's still designed to create fear, uncertainty, and doubt in the reader, so that a certain number of them will go "Oh what the hell, I'll just send them the money and they can take care of it." If you get one of these, throw it away. To renew your registration, just go to the Secretary of State's online renewal site and take care of it yourself. Here's what this year's bait for the scam looks like (I added the "NOT APPROVED" stamps). If you're in a business or nonprofit, you have much better things to do with your money than pay someone $100 or more to do something in under five minutes you can easily do yourself in under three.
If you help manage money or property for a family member or friend who can't do it themselves, you know that being someone's informal financial caregiver (or formally appointed representative payee or conservator or trustee) can be really tough. These jobs are all called "fiduciary" positions, because you have a legal "fiduciary" duty, meaning you must be faithful and loyal to the person you are helping, putting their interests ahead of your own. ("Fiduciary" is from Latin fidelis, meaning faithful.) The Consumer Financial Protection Bureau created the Managing Someone Else’s Money guides for four different fiduciary roles. They also created a brief video that explains the guides featuring the experiences of two lay fiduciaries. Attorneys for Wall Street and bottom on the barrel debt collectors alike are trying to get out of having to follow federal law that protects consumers by limiting the kinds of tactics that collectors can use. Right now, the Fair Debt Collection Practices Act covers debt collecting attorneys the same as all other debt collectors. Lawyers for the collectors are trying to give themselves an immunity shield so that they can go back to using these abusive tactics without fear of being held to account by consumers. If anything, by virtue of being attorneys, attorneys who collect debts should be held to a HIGHER standard, not allowed to break the law with impunity. Let your congressional representatives know that you OPPOSE ANY EFFORT TO EXEMPT ATTORNEYS FROM THE FDCPA. Here's the text of an alert on the subject from the National Consumer Law Center. A bill pending in the U.S. House of Representatives, H.R. 5082, Practice of Law Technical Clarification Act of 2018 (Mooney-Gonzalez) (amending the previously filed H.R. 4550), would exempt attorneys and law firms engaged in litigation from the Fair Debt Collection Practices Act (FDCPA) and eliminate Consumer Financial Protection Bureau (CFPB) authority over them.

"Don't buy a used car until you've read this" Excerpts from a great article from the cool folks at IFixIt (IFixIt.org) We’re afraid of warranty stickers, but really, manufacturers should be I have had a number of very unhappy consumer victims of scams where they received very convincing calls from someone with an authoritative voice who told them that they were going to be arrested/audited/exposed as a liar/cheat/unfit parent/tax fraud unless they went to Apple (or Google or Wal-Mart) and bought gift cards and gave the codes from the cards to the person calling. It's easy for you and I to sit back and say "That's an obvious scam" but it's not obvious sometimes, when you're tired and don't expect someone to call and threaten you. Once your amygdala fear response kicks in, your reasoning declines dramatically. So just remember -- just like money never calls you on the phone, only scammers demand payment in gift card codes. Never buy a gift card because someone threatened you! (Unless it's your wife.) Scammers demand gift cards | Consumer Information The short answer to "How do criminals steal from the elderly?" is "by phone, mostly." And new phone-based payment services that let you send money to others without even leaving your house make it crucial that you remember this key survival rule: MONEY NEVER CALLS YOU ON THE PHONE. And if you think you've found the exception to this rule, call an attorney or a trusted friend with good sense to discuss the offer before you do ANYTHING that the caller suggests. If you have truly found the exception to the rule, it'll wait for you to conduct a thorough investigation. If you feel ANY pressure to seize the opportunity at all, that's the clearest sign of all that it's a SCAM. Remember, the phone and internet means just one thing for sure: Every criminal in the entire world is just one click or phonecall away from you. In years past, you pretty much only did business with people nearby; now you can be ripped off by someone from a country you can't even pronounce just as easily as by someone who calls you from a boiler-room scam operation in your own hometown.
